Commercial EPCs

From April, all commercial EPCs will need to be lodged in accordance with the Use Classes order. All sellers and commercial agents accordingly need to make sure that they know what Use Class the property they are selling or letting is in. Click here for the up-to-date Use Classes Order.

Don't forget - if you are marketing any commercial property for sale or let you MUST have a commercial EPC. The standard penalty is 12.5% of the rateable value of their property subject to minimum and maximum figures. Trading standards are now looking at compliance with property legislation and only last November Birmingham Trading Standards carried out an investigation into HIPs visiting Estate Agents to look at relevant documentation. You should note that Trading Standards have the power to impose fines without recourse to court action.

Industry News

From the 6th of April there are amendments being made to Home Information Packs that sellers and estate agents should be aware of:

  • Previously sellers had 28 days in which a HIP had to be produced during which time they could market a property. From the 6th of April you will not be able to market a property unless a HIP has been fully completed.
  • There is a new addition to the HIP - the 'Property Information Questionnaire'. This is an informative questionnaire that sellers will have to fill out about their property. The questionnaire can be viewed here.
